Sourcing E-Bikes or E-Scooters from China? UL 2849 Isn’t a Box-Ticking Exercise — New York’s Real Data Proves It

If you source e-bikes or e-scooters from China to sell in the US, you’ve probably seen the certification numbers UL 2849, UL 2271, and UL 2272 more than once. This time, we want to show you a rare thing in compliance writing: real, before-and-after data proving these standards actually save lives, not just paperwork. Over 80% of e-bikes sold in the US are imported from China — the compliance quality of this category directly determines the safety of thousands of households.

1. Data worth taking seriously: after mandatory certification, deaths actually fell

In 2023, lithium battery fire deaths in New York City hit an annual peak of 18, with 268 lithium battery fires and 150 injuries citywide. That September, NYC’s Local Law 39 took effect, requiring every e-bike, e-scooter, and battery sold or leased in the city to be certified to UL 2849 (electrical systems for e-bikes), UL 2272 (personal e-mobility devices), and UL 2271 (batteries for light electric vehicles).

The result: in the first year after the law took effect, deaths fell 79% (from 14 to 3 in a comparable period); by 2025, the full-year death toll had dropped to just 1. This isn’t a model projection — it’s real data published by the FDNY. What this data shows: this isn’t a paperwork burden — it’s a technical threshold that genuinely prevents tragedy.

2. You need to distinguish three separate certifications — many businesses trip up on scope

These three UL standards govern entirely different product layers — don’t mix them up:

  • UL 2849 governs the whole-bike electrical system (covering the battery management system, software evaluation, functional safety, plus the controller, motor, and charger). Applies to: electrically power-assisted cycles (EPACs), road-legal e-scooters, and electric motorcycles. Note: UL 2849 does not cover frame strength or braking performance — those fall under the federal Bicycle Safety Requirements, 16 CFR 1512, which must be satisfied separately.
  • UL 2272 governs personal e-mobility devices not suitable for road use — hoverboards, standing scooters, self-balancing unicycles.
  • UL 2271 governs standalone battery packs sold separately or supplied to other equipment manufacturers (relevant if you’re a battery-pack maker whose product is sold on its own or built into other companies’ vehicles).

A common trap: assuming “the battery is UL 2271 certified” means the whole bike is compliant — it doesn’t. UL 2849 certifies the safety of the entire system — battery, charger, and controller — working together. Even if the battery pack itself carries a UL 2271 certificate, the e-bike you’re buying isn’t compliant unless the complete system also holds UL 2849 certification.

3. Certification isn’t a one-time test — it requires annual factory audits

This is something many buyers don’t know: the UL certification process includes application, document review, a factory audit, sample testing, and certificate issuance — followed by annual audits to confirm production continues to meet the standard. This means a supplier genuinely holding UL 2849 certification is under ongoing UL audit — you can ask them for records of their most recent annual audit, which tells you more about sustained compliance than a single certificate does (see our certificate-verification guide).

4. This isn’t one federal rule — it’s an expanding state-by-state patchwork

  • NYC (since September 2023) and New York State (since July 2024): mandatory — no manufacturing, distribution, or sale without certification, with civil penalties of $500 to $1,000 per violation.
  • California SB 1271 (effective January 1, 2026): introduces strict testing requirements for all e-bikes and e-mobility devices sold, leased, or distributed in California, requiring certification through an accredited testing laboratory.
  • San Francisco, Washington D.C., Denver: currently lean more toward charging/storage safety guidance and incentive programs, not yet an outright sales ban like New York’s.
  • Federal level: no unified national mandate yet, though a bipartisan bill (the Setting Consumer Standards for Lithium-Ion Batteries Act) is under consideration but not yet passed. CPSC has separately issued stop-use warnings for specific battery products (such as certain Rad Power Bikes battery batches).

What this means for you: if your product needs to cover multiple US markets, you can’t just check “is there a federal rule” — New York and California, two of the biggest markets, already have clear mandatory thresholds, and other states and cities vary and need individual verification.

5. What to do before you order

  • Identify exactly which category your product falls into and which standard(s) apply — full bikes need UL 2849 (plus 16 CFR 1512 for mechanical safety), non-road personal devices need UL 2272, standalone batteries need UL 2271. Don’t mix these up.
  • Require the full certification report from your supplier, and verify it’s a system-level certification — ask explicitly whether the certification tested the battery alone, or the complete battery + charger + controller system together.
  • Request records of the annual factory audit, not just the original certificate issued at approval.
  • Verify the specific requirements of the state/city you’re selling into — New York and California already have explicit mandates; other regions are catching up at different paces.
  • If selling on marketplaces like Amazon, confirm the platform’s own requirements in advance — Amazon and eBay already require a UL 2849 report before an e-bike listing is allowed to go live.

The bottom line

UL 2849, UL 2271, and UL 2272 certification isn’t a paperwork formality — New York’s real data shows that after these standards became mandatory, lithium battery fire deaths fell by nearly 90%. What buyers need to do: understand what each standard actually governs, confirm you’re getting system-level certification rather than just a battery-only cert, verify your supplier’s ongoing audit record, and track the specific thresholds in leading markets like New York and California that have already legislated.
